These terms
These terms govern your use of alcyone.finance and any page that carries the Alcyone by TrustSwap name (the "site"). The site is operated by TrustSwap El Salvador, S.A. de C.V., a company incorporated in the Republic of El Salvador, with registered office at Polígono 8, Oficina 118, Colonia San Benito, San Salvador, El Salvador ("TrustSwap", "we" or "us"). Alcyone is the advisory practice of TrustSwap and is not a separate legal entity.
By using the site you accept these terms. If you do not accept them, please do not use the site. We may change these terms by posting a revised version on this page; the version posted at the time you use the site is the one that applies.
What the site is for
The site describes our advisory practice, the areas we work in and examples of past work, and lets you ask for an introductory call. It is provided for general information only.
Nothing on the site is investment, legal, tax, accounting or regulatory advice, and nothing on it is an offer, solicitation or recommendation to buy, sell or hold any token, digital asset, security or other financial instrument, or to use any platform or service. Digital assets carry significant risk, including the risk of total loss, and their regulatory treatment differs between jurisdictions and changes often. You should take your own professional advice before acting on anything you read here.
The case examples on the site describe past engagements with client names withheld. They are illustrative. Past results do not predict the outcome of any future engagement, and figures quoted are those recorded at the time of the work.
Advisory services are separate
Reading the site, submitting the contact form or holding an introductory call does not make you a client of TrustSwap and does not create an advisory, fiduciary or contractual relationship. Advisory services are provided only under a written engagement letter signed by both parties, and that letter, not these terms, governs the engagement, including scope, fees, confidentiality and liability.
We are selective about the projects we take on and may decline any enquiry without giving a reason.
Using the site
You may use the site for lawful purposes connected with evaluating our services. You may not use it in any way that breaks the law, that damages, disables or overloads the site or the systems behind it, that attempts to gain unauthorised access to any part of it, that scrapes or harvests data from it other than as our robots.txt permits, or that misrepresents who you are when you contact us. We may suspend or block access to the site at any time.
Information you send us
Anything you send through the contact form or by email is treated as confidential in the way described on the contact page and handled as set out in our Privacy Policy. You are responsible for making sure you have the right to share it. Please do not send us confidential information belonging to a third party, private keys, seed phrases or credentials of any kind; we will never ask for them.
Intellectual property
The site and everything on it, including the Alcyone name and mark, the kingfisher device, the text, images, films, icons, layout and code, belong to TrustSwap or its licensors and are protected by copyright, trade mark and other laws. You may view the site and print or download extracts for your own reference in evaluating our services. You may not otherwise copy, reproduce, adapt, publish or commercially exploit any part of it without our written permission. Quoting a short passage with attribution and a link is fine.
Team Finance, TrustSwap Launchpad, The Crypto App and Panthea are TrustSwap products and marks. Other names and marks that appear on the site belong to their owners and are used for identification only.
Other TrustSwap products and third-party sites
The site links to other TrustSwap properties and to third-party websites. Each is governed by its own terms and privacy policy. Nothing on this site obliges you to use any TrustSwap product, and our advice does not depend on your doing so. We are not responsible for the content or availability of third-party sites, and a link does not imply endorsement.
No warranty
The site is provided as it is and as available. We take care to keep it accurate and current, but we make no promise that it is complete, correct, up to date, secure, free of errors or viruses, or available without interruption, and we may change or withdraw any part of it at any time. To the fullest extent the law allows, we exclude all conditions, warranties and representations, express or implied, in relation to the site and its content.
Limitation of liability
To the fullest extent the law allows, TrustSwap, its group companies, and their directors, officers, employees and agents will not be liable to you for any loss or damage arising from your use of, or inability to use, the site or its content, or from reliance on anything on it, whether in contract, tort (including negligence), breach of statutory duty or otherwise, and including any indirect or consequential loss, loss of profit, loss of data or loss of digital assets.
Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot be excluded by law. Liability arising under an advisory engagement is governed by the engagement letter, not by this section.
Indemnity
You agree to indemnify TrustSwap against any loss, liability or cost arising from your breach of these terms or your misuse of the site.
Governing law and disputes
These terms, and any dispute or claim arising out of or in connection with them or the site, are governed by the laws of the Republic of El Salvador. The courts of San Salvador, El Salvador have exclusive jurisdiction to settle any such dispute or claim. If any provision of these terms is found to be invalid or unenforceable, the rest continue in full effect.
